In a decision released on Monday, U.S. Senator Bob Menendez faced a legal setback when his challenge against the constitutionality of search warrants in his corruption case was dismissed by a federal judge.
Delivering the ruling, Judge Sidney H. Stein confirmed that the 2022 searches on the New Jersey Democrat’s emails and home, which unearthed gold bars and cash, were in line with constitutional standards.
Menendez’s defense team had contested the validity of the warrants, arguing that they contained significant misrepresentations that misled the authorizing judge.
Nonetheless, Judge Stein determined that any potential mistakes in the warrant applications were neither significant nor deliberate, obviating the need for a separate hearing to delve into those assertions. Challenges to the warrants brought forward by another accused individual in the case were also overruled.
The operations that took place between January and July of 2022, including an additional search targeting cell phones in September, led to striking discoveries.
As part of the June 2022 searches at his residence, authorities reported finding over $100,000 in gold bars and more than $480,000 in cash, arranged in various hiding spots such as closets and a safe.
The indictment showcased images with cash concealed within envelopes in jackets tagged with Menendez’s name. Additionally, the indictment referenced a search conducted by Menendez on the price of a kilo of gold, and purported briber’s DNA found on an envelope packed with money.
Asserting his innocence, 70-year-old Menendez rebutted the charges, stating the found cash was part of his emergency savings. Despite being stripped of his role as chair of the Senate Foreign Relations Committee post-arrest, he affirmed his intent to remain in Congress. Nadine Menendez, the senator’s wife, along with two businessmen, also maintained their innocence. However, one of the charged businessmen has recently accepted a plea deal that includes cooperating with the prosecution.
The court has scheduled the trial for May, and Menendez’s defense team did not comment on the recent judicial ruling. The prosecution declined to issue a statement as well.
Judge Stein’s ruling emphasized that the affidavits backing the warrant requests only required probable cause to be demonstrated for the recovery of incriminating evidence. He expressed satisfaction that the evidence detailed fulfilled this requirement.
Allegations state that the Menendez couple accepted gold and cash from a developer in exchange for the senator’s influence in securing a real estate deal with a Qatari fund. Another charge implicates the senator in aiding a New Jersey entrepreneur to land a deal with the Egyptian government.
